DMCA Policy for bushpost.com

Bushpost.com respects the intellectual property rights of others and is committed to complying with the provisions of the Digital Millennium Copyright Act (DMCA). We will respond to any claims of copyright infringement that are reported to us in accordance with the procedure outlined below.

This policy applies to all content published on bushpost.com, including articles, images, and other media across our various categories: Business, Technology, Fashion, Health, Travel, and Sports.

How to File a Copyright Infringement Notification

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that any content hosted on bushpost.com infringes upon your copyright, you may submit a DMCA takedown notice. To do so, please provide our designated Copyright Agent with the following information in writing:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works is acceptable.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled. Please include information reasonably sufficient to permit us to locate the material (e.g., the URL of the page where the content appears).
  4. Information reasonably sufficient to permit us to contact you, such as your name, address, telephone number, and, if available, an email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Our Response to a Valid Notice

Upon receipt of a valid DMCA notification as described above, bushpost.com will:

  • Promptly remove or disable access to the allegedly infringing material.
  • Notify the user who posted the content that we have removed or disabled access to it.
  • In the case of repeat infringers, we reserve the right to terminate their ability to contribute to the site and take other appropriate action.

Counter-Notification Procedure

If you believe that your content was removed or access was disabled by mistake or misidentification, you may send a counter-notification to our Copyright Agent.

Your written counter-notification must include the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location (URL) at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which bushpost.com may be found), and that you will accept service of process from the person who provided the original copyright infringement notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA notice. This will inform them that we may replace the removed material or cease disabling access to it in 10 business days. Unless our Copyright Agent receives notice that the original complaining party has filed an action seeking a court order against the content provider, we may restore the material within 10 to 14 business days after receipt of the counter-notice.
